Terms of Service

These Terms of Service govern your use of the Visbee website and platform. By accessing or using our services, you agree to be bound by these terms. Please read them carefully.

1. Definitions

  • Provider / "we", "us" - Victus Wiktor Dyngosz, a sole proprietorship registered in Poland, ul. Zakładowa 9H/20, 50-231 Wrocław, Poland, tax identification number (NIP): 8971810792. Contact: [email protected].
  • User / "you" - any natural person, legal entity, or organizational unit using the Service.
  • Service - the Visbee platform for AI brand visibility monitoring, accessible at https://visbee.ai, including all related features and tools.
  • Account - your personal access to the Service, created upon registration.
  • Subscription - a paid plan granting access to specific Service features for a defined billing period.
  • Content - any data, text, reports, or materials generated through or uploaded to the Service.
  • Consumer - a natural person using the Service for purposes not directly related to their business or professional activity, as defined by Polish and EU law.

This information is provided in accordance with the Polish Act on Providing Services by Electronic Means (Ustawa z dnia 18 lipca 2002 r. o świadczeniu usług drogą elektroniczną).

3. Scope of services

Visbee is an AI brand visibility monitoring platform. The Service allows you to:

  • Monitor how AI assistants (such as ChatGPT, Perplexity, Claude, Grok, and DeepSeek) mention and recommend your brand.
  • Track brand sentiment across AI platforms over time.
  • Benchmark your brand visibility against competitors.
  • Generate reports and receive automated insights.

The specific features available to you depend on your Subscription plan. Feature details and plan comparisons are described on our pricing page.

The Service is provided in English and Polish.

4. Technical requirements

To use the Service, you need:

  • A device with internet access and a modern web browser (Chrome, Firefox, Safari, or Edge, latest two major versions).
  • A valid email address.
  • JavaScript enabled in your browser.

5. Account registration

To use the full Service, you must create an Account by providing accurate and complete information. You are responsible for:

  • Maintaining the confidentiality of your login credentials.
  • All activity that occurs under your Account.
  • Notifying us immediately of any unauthorized use of your Account.

You must be at least 18 years old to create an Account. Each person may hold only one Account unless otherwise agreed in writing.

We reserve the right to suspend or terminate Accounts that contain false information or violate these Terms.

6. Waitlist

Before the full Service is available, you may join our waitlist by submitting the form on our website. By joining the waitlist, you consent to us processing your data as described in our Privacy Policy and to receiving communications about the Service launch.

Joining the waitlist does not create an obligation to purchase a Subscription or use the Service.

7. Subscriptions and payments

Billing: Subscriptions are billed in advance on a monthly or annual basis, as selected by you at checkout. Prices are displayed in the currency indicated on the pricing page and include applicable taxes where required by law.

Auto-renewal: Subscriptions automatically renew at the end of each billing period unless you cancel before the renewal date. We will notify you at least 7 days before renewal via email to the address associated with your Account.

Payment methods: We accept payment methods as indicated during checkout. All payments are processed through third-party payment providers. We do not store your payment card details.

Price changes: We may change Subscription prices. Any price increase will take effect at the start of your next billing period, and we will notify you at least 30 days in advance. If you do not agree with the new price, you may cancel your Subscription before the new period begins.

Failed payments: If a payment fails, we will attempt to collect it again. If payment cannot be collected after reasonable attempts, we may suspend your access to the Service until payment is resolved.

8. Right of withdrawal (Consumers)

If you are a Consumer within the European Union, you have the right to withdraw from a distance contract within 14 days of its conclusion, without giving any reason.

To exercise this right, send a clear statement to [email protected] before the withdrawal period expires. You may use the following template:

"I hereby withdraw from the contract for the provision of the Visbee service, concluded on [date]. Name: [your name]. Email: [your email]."

Upon withdrawal, we will refund all payments received from you within 14 days using the same payment method.

Exception: If you explicitly consent to the commencement of service delivery before the withdrawal period expires and acknowledge that you will lose the right of withdrawal once the service is fully performed, the right of withdrawal may not apply. We will ask for this consent explicitly during checkout.

This right also applies to sole proprietors acting in a non-professional capacity, in accordance with Polish law (Art. 38a of the Consumer Rights Act, as amended).

9. Refund policy

Beyond the statutory right of withdrawal described above:

  • Annual plans: If you cancel within 30 days of the initial purchase, we will issue a pro-rated refund for the unused portion.
  • Monthly plans: No refunds for the current billing period after the 14-day withdrawal period has passed. You retain access until the end of the paid period.

10. Acceptable use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of applicable laws.
  • Attempt to reverse engineer, decompile, or disassemble the Service.
  • Scrape, crawl, or use automated means to access the Service beyond the features we provide.
  • Interfere with or disrupt the Service infrastructure.
  • Share your Account credentials with third parties.
  • Use the Service to harm, harass, or infringe on the rights of others.
  • Resell access to the Service unless authorized under an agency or reseller agreement.
  • Submit false, misleading, or malicious data through any form or API.

We may suspend or terminate your Account if you violate these rules, with prior notice where reasonably possible.

11. Intellectual property

Our property: The Service, including its software, design, branding, documentation, and all related intellectual property, is owned by the Provider. Nothing in these Terms grants you ownership of the Service or its components.

Your data: You retain full ownership of all data you provide to the Service (such as brand names, prompts, and configuration). We do not claim any intellectual property rights over your data.

Reports and insights: Reports and insights generated by the Service based on your data are provided for your use. You may share, export, or publish them freely.

License: We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for the duration of your Subscription.

12. Service availability

We strive to maintain the Service available 24/7, but we do not guarantee uninterrupted access. The Service may be temporarily unavailable due to:

  • Scheduled maintenance (we will provide advance notice where possible).
  • Emergency maintenance or security updates.
  • Factors beyond our control, including third-party service outages, internet disruptions, or force majeure events.

We are not responsible for the availability, accuracy, or behavior of third-party AI platforms that we monitor (such as ChatGPT, Perplexity, Claude, Grok, or DeepSeek). Changes to these platforms may affect the Service's functionality, and we will adapt as reasonably possible.

13. Limitation of liability

For business users: To the maximum extent permitted by law, the Provider's total liability under these Terms is limited to the amount you paid for the Service in the 12 months preceding the event giving rise to the claim. We are not liable for indirect, incidental, consequential, or punitive damages, including lost profits or data.

For Consumers: Nothing in these Terms limits or excludes liability that cannot be limited or excluded under applicable law, including liability for damages caused intentionally or through gross negligence. Your statutory consumer rights under Polish and EU law remain fully protected.

General: We are not liable for losses resulting from your use of insights or reports generated by the Service as a basis for business decisions. The Service provides monitoring data, not business advice.

14. Data and privacy

We process personal data in accordance with our Privacy Policy, which is an integral part of these Terms.

Data export: You may export your data from the Service at any time through the available export features.

Data after termination: After your Account is terminated or your Subscription expires, we will retain your data for 30 days to allow you to export it. After this period, your data will be permanently deleted, except where retention is required by law.

15. Complaint procedure

If you are dissatisfied with the Service, you may submit a complaint by email to [email protected]. Please include:

  • Your name and email address associated with your Account.
  • A description of the issue.
  • Your expected resolution.

We will acknowledge your complaint within 3 business days and provide a substantive response within 14 days. If we need more time due to the complexity of the issue, we will inform you of the expected resolution date, which will not exceed 30 days from receipt.

If you are a Consumer and are not satisfied with our response, you may use the EU Online Dispute Resolution platform at https://ec.europa.eu/odr, or contact a competent consumer ombudsman in Poland.

16. Termination

By you: You may cancel your Subscription or delete your Account at any time through the Service settings or by contacting us. Cancellation takes effect at the end of the current billing period.

By us: We may terminate or suspend your Account if:

  • You materially breach these Terms and fail to remedy the breach within 14 days of our written notice.
  • You engage in activity that threatens the security or integrity of the Service.
  • Required by law.

Effect of termination: Upon termination, your right to use the Service ceases. You will have 30 days to export your data (see Section 14). Any prepaid fees for unused service periods will be refunded pro-rata, except where termination is due to your breach of these Terms.

17. Changes to these Terms

We may update these Terms from time to time. When we do:

  • We will publish the updated Terms on this page with a new "Last updated" date.
  • For material changes, we will notify you by email at least 30 days before they take effect.
  • If you do not agree with the updated Terms, you may terminate your Account before the changes take effect. Continued use of the Service after the effective date constitutes acceptance of the new Terms.

We will not reduce your rights under these Terms without your explicit consent.

18. Governing law and disputes

These Terms are governed by the laws of the Republic of Poland.

For Consumers: Any disputes will be resolved by the court having jurisdiction over the Consumer's place of residence, in accordance with applicable EU and Polish consumer protection law. You also have the right to use out-of-court dispute resolution procedures, including the EU ODR platform.

For business users: Any disputes arising from these Terms will be resolved by the courts having jurisdiction over the Provider's registered office in Wrocław, Poland.

19. Severability

If any provision of these Terms is found to be invalid or unenforceable by a competent court, the remaining provisions will continue in full force and effect. The invalid provision will be modified to the minimum extent necessary to make it valid and enforceable while preserving its original intent.
